A significant development came in Tay Wee Kiat and another v Public Prosecutor and another appeal [2018] SGHC 42, when a three-Judge High Court introduced a sentencing framework specifically addressing cases involving physical and psychological harm to domestic helpers.
The framework recognises that maid abuse cannot always be assessed simply by looking at the physical injuries suffered. A domestic helper may also experience significant psychological harm, particularly where the offending involves repeated abuse, humiliation, intimidation or a pattern of controlling behaviour.
In determining the appropriate sentence, the Court considers the seriousness of both the physical and psychological harm caused, before considering other aggravating and mitigating factors.
The sentencing framework below provides an indication of how the courts approach such cases.

Once the Court assesses seriousness, next up is PUNISHMENT:

It was noted that the Court should adjust each sentence when considering aggravating factors (e.g. use of a weapon; repeated abuse) as well as mitigating factors (e.g. abuser’s remorse). Finally, the Court decides which sentences will run consecutively, bearing in mind the duration and frequency of abuse.
